CAPITOL TECHNOLOGIES, INC. ("CAPTECH") warrants to the original purchaser of this battery if purchased from an authorized CAPTECH Dealer that, should it prove defective by reason of improper workmanship and/or material and/or performance:

1. Parts. For one year from the date of original purchase we will repair or replace, at our option, any defective part without charge for the part. Parts used for replacement are warranted for the remainder of the original warranty period.
2. Labor. For one year from the date of original purchase, we will provide the labor for a warranty repair without charge at our service center.
3. Performance. For one year from the date of original purchase, the battery must perform at a minimum of eighty percent (80%) of it’s original performance specifications or we will repair or replace, at our option, the battery.
4. Notice. To obtain warranty service, you must notify CAPTECH of any defect within the applicable warranty time period.

TO OBTAIN WARRANTY SERVICE, deliver your battery to CAPTECH . Shipping expenses are your responsibility. Proof of purchase date is required when requesting warranty service. Send copy of invoice to establish proof and date of purchase.

THIS WARRANTY DOES NOT COVER damage caused by: modification, alteration, repair or service by anyone other than CAPTECH; physical abuse to, or misuse of, the battery; freight damage; or any damage caused by acts of God.

ANY EXPRESS WARRANTY NOT PROVIDED HEREIN, AND ANY REMEDY WHICH, BUT FOR THIS PROVISION, MIGHT ARISE BY IMPLICATION OR OPERATION OF LAW, IS HEREBY EXCLUDED AND DISCLAIMED. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO A TERM OF ONE YEAR.

UNDER NO CIRCUMSTANCES SHALL CAPTECH BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, OR OTHERWISE.

Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental, special, or consequential damages, so the above limitations or exclusions may not apply to you.

This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
